NOTICE INVITING TENDERS

FOR IMAGING & ANALYSIS OF DIGITAL DATA

 

Sealed quotations are invited from the firms who are engaged in providing Forensic Imaging and analysis of digital data as per details given in the Annexure-‘A’ to this tender.

 

Nature of work:  

 

It is intended to avail the services of a third party for the purpose of forensically acquiring and forensic analysis of digital data, using hardware & software whose specifications match or exceed that of specified in software & hardware specs , and which are capable to process and analyze various queries made by the analyst.

 

Place of Work:  

 

Either at Office situated at Central Excise Building, Telangkhedi Road, Civil lines, Nagpur along with Divisional offices situated at Bhandara, Chandrapur  Amravati and their subordinate field offices or on the locations specified by the authorities of Central Excise, at the time specified by the same.

 

Bid Security (Earnest Money)  to deposited :        

Bank Draft or Bank Guarantee of Rs. 5000/-  from any of the Commercial banks in the name of Assistant Chief Accounts Officer, Central Excise, Nagpur

 

Time Allowed :             

One year contract from the date of awarding quotation of the Contract.

 

Sealed quotation may be submitted by the firms, fulfilling the terms and conditions as mentioned in Annexure-‘A’ and Annexure-‘B’, in two separate covers super scribed “Technical Bid for Forensic Imaging and Analysis of digital data” & “Financial Bid for Forensic Imaging and analysis of digital data”. The letter should be addressed to the Undersigned and should reach at the earliest, but not later then 17:00 Hrs on   03/12/2010. Both these covers may be put in an envelope which may be sealed and deposited within Office of Assistant Commissioner (Systems), Customs & Central Excise, Nagpur during working hours, between 9.30 am to 6.00 pm before the time limit indicated above. The quotations will be opened on 06/12/2010 at 11:00 hrs in the presence of the Tender Committee and in the presence of the parties or their authorized representatives, if any, who wish to participate at the Office of the Commissioner of Central Excise, Civil Lines, Nagpur. The ‘Technical Bid’ would be opened first and only those firms, who fulfill the Technical terms & conditions, will be eligible for participating in the ‘Financial Bid’.

 

The Commissioner, Central Excise Nagpur would not be responsible for any delay or loss of the tender document through mail or otherwise.

 

The Commissioner, Central Excise Nagpur reserve the right to reject all / part or any of the quotations without assigning any reason thereof. No correspondence in this regard will be entertained.

ANNEXURE – A

TECHNICAL BID

 

THE PROCESS OF FORENSICALLY ACQUIRING AND FORENSIC ANALYSIS OF DIGITAL DATA EXPECTED FROM THE BIDDERS:

 

1.      Acquisition of Data

Computer Forensic Hardware to be used to acquire data from a machine, and make an exact Copy/Clone/Image of everything stored on the hard disks. Because the investigator is studying this Copy/Clone/Image of the computer’s data, the machine’s original data is unaltered during later examination. The computer forensic technician can then study the suspect computer’s contents through a Clone/Image of the data, leaving the original data untouched.

 

2.      Authentication of data

To authenticate the data that’s acquired from a suspect computer, various hashing algorithms (CRC32, MD5, SHA1, SHA2) can be used to compare the data that’s duplicated in the imaging process to the original data on a suspect’s computer.

 

3.      Analysis of data
Analysis is the process of examining and evaluating information, which could include

 

·        Create images

·        Analyze the Document’s, Spreadsheet’s, Accounting Packages

·        Analyze the Registry

·        Analyze Emails

·        Powerful index search engine and a proper full-feature regular expression engine.

·        Analyze Browser Data and browsing contents.

·        Conduct an investigation

·        Decrypt files

·        Recovery of Deleted data

·        Cracking all types of passwords

·        Identify steganography

·        Build a report all with a single solution and its printing.

 

4.         PROVEN EXPERIENCE

            The bidders should be a regular Contractor for Digital Acquisition & Digital Analysis of Digital Equipment. The Bidder should have carried out similar jobs including digital Acquisition & Digital Analysis of Digital Equipment in the Past. The Bidder should have proven independent capability to complete the jobs as mentioned above. The bidder should have the expertise and experienced manpower to complete the job as mentioned in scope of work.

 

                       The Bidders should be in the above business at least for the last 3 years. Requisite documents to support this claim will have to be produced for verification. The Bidders must have experience in the field of

1.      Forensic Analysis Tools

2.      Password Recovery

3.      Forensic Imaging Device

4.      Registry Analysis Tool

5.      Forensic Text indexer

6.      Steganography Tool 

7.      Mobile Phone Data Extraction & Analysis Kit

8.      Portable Data Extraction & Analysis Kit (Incident Response Tool)

 

GENERAL TERMS AND CONDITIONS

 

1          It is intended to avail the services of a third party for the purpose of forensically acquiring and forensic analysis of digital data, using hardware & software whose specifications match or exceed that of specified in software & hardware specs , and which are capable to process and analyze various queries made by the analyst.

 

2          To provide either at Office situated at Central Excise Building, Telangkhedi Road, Civil lines, Nagpur along with Divisional offices situated at Bhandara, Chandrapur  Amravati and their subordinate field offices or on the locations specified by the authorities of Central Excise, at the time specified by the same.

 

3          The firm shall maintain the equipments and shall use genuine /original Components, wherever needed.

 

4          The contract can be terminated summarily by this Department at any time without giving any notice or without assigning any reason, if the work of the contactor is found unsatisfactory during the currency of this contract.

 

5          The Commissionerate shall have the right to inspect company’s site to assess infrastructure before awarding the AMC and it may reject in the event of Deptt’s dissatisfaction about company’s infrastructure or otherwise.

 

6          The Contract shall initially be for a period of one year from the date of finalization of the contract. The contract may be renewed for further period of one year with same terms & conditions, if the Department is satisfied, up to maximum of two renewals.

 

7          It shall be the responsibilities of the firm to make all the computers and peripheral work satisfactorily throughout the contract period and to hand over the systems in working conditions to the Department after expiry of the contract.

 

8          This tender is not transferable and under no circumstances the successful bidder shall be allow to sub-contract with any other person/party.

 

9          In case the contracting firm is not able to accept the contract after it is awarded or if they are not able to do the work after accepting the contract such firm will be liable to pay the damage to the Department including the cost which the Department will have to incur for getting such work done.

 

10        The above act of backing out would automatically debar the contractor from any further dealing with this Department and the security money would also be forfeited.

 

11     If the company does not attend the services within 3 hours from the time of authority called to the engineers, the penalty of Rs. 100/- per hour shall be levied.

 

12        Penalty shall be levied at the rate of Rs.500/- for the delay in cloning of hard disk, analysis of data etc. in the time prescribed by the department or by the company for the activities.

 

13        If the company fails to give services to the department, the expenditure incurred there on shall be recovered from the company, apart from the penalty levied as stated in preceding Para. This may even entail termination of the contract & forfeiture of security deposit.

 

14        No advance payment will be made in any case. Payment shall be made quarterly at the end of each quarter after satisfactory completion of maintenance on the basis of quarterly service report duly countersigned by the competent officer of the Commissionerate.

 

15        The company will not have any legal right to proceed against the Department in the event of late payment due to unforeseen reason.

 

16        The disposal of Earnest Money Deposit amount would be after conclusion/termination of contract.

 

17        Penalty shall be deducted from the running payments.

Annexure – B

 

FINANCIAL TERMS & CONDITIONS:-

 

1.      The Financial bid should contain the rate against each item separately

 

            A.        Rate of Supply of Hard Disk for Cloning (Brand name and Size of Hard disk),

            B.        Rate of Cloning of Hard Disk,

            C.        Rate of Digital Analysis (which includes Searching, Indexing, Hidden Data, Compete Report Information, Retrieving Deleted Data, Password Cracking, Decryption of Encrypted data, Printing, or any other as per the Technical Bid)

            D.        If any other Rate to be quoted

 

2.         The quotations should be accompanied by an earnest money of Rs. 5000/- in the form of Bank Draft or Bank Guarantee in the name of the Pay & Accounts Officer, Nagpur. Cash and cheque will not be accepted. Quotations received without earnest money shall be summarily rejected without assigning any reason there of and no tenderer shall have any right to represent against it, even if, his quotations happen to be lowest. The earnest money shall be returned to the successful and unsuccessful bidder after the finalization of the contract.

 

3.         The firm whose quotation is finally accepted shall have to deposit a sum equivalent to 10% of the contract amount as Performance Security in the form a Bank Guarantee. The Bank Guarantee should be valid for a period of Sixty days beyond the date of completion of all contractual obligation of the successful bidder. The security deposit will be released after satisfactory completion of the contract. On submission of Security Deposit, earnest money will be refunded.

 

4.         The firms meeting the above financial terms & conditions only should submit their quotations in a sealed cover. The firm who fails to fulfil any of the above conditions will be disqualified.
